Bankruptcy

With the new bankruptcy laws, many people believe that they can no longer file for bankruptcy protection, or that they can only file a Chapter 13 bankruptcy.  That notion is simply not true.  The reality is that bankruptcy protection is still readily available, and, most petitioners still qualify for Chapter 7 protection, which is more advantageous given that most debts are immediately discharged, or in other words, do not have to be paid.  There might be more work on our end, but for many clients it is almost as easy as ever.

With an unstable economy, bankruptcy becomes more and more common.  Many of our clients who approach us about bankruptcy have already tried credit counseling, loans, and other methods to get out of debt.  Sometimes it is simply too much to overcome.   If you find yourself overloaded with debt, perhaps we can help you as we have many others in Bradford, Sullivan, Wyoming, and Susquehanna Counties.

What is Bankruptcy?

Bankruptcy is a proceeding in federal court that gives you relief from certain debts.   A successful bankruptcy means that a person no longer has to pay back certain debts--and creditors cannot contact them in any way to try to collect those debts! What is more, simply filing a bankruptcy creates an "automatic stay" which simply means that creditors are prohibited from trying to collect the debt until the bankruptcy is complete.  That's right--the phone will stop ringing when the bankruptcy is filed, and won't start ringing (from bill collectors) again if the bankruptcy is successful!   To find out what debts can be included and whether bankruptcy is right for you, please contact us for a confidential appointment.
