Arizona Asset Protection: 5 Legal Strategies for High-Net-Worth Estates
00:21:29
Francisco Sirvent: Welcome, everybody. We’ll get started in just a minute. You’re in the right spot. Well, good afternoon. Today we are addressing the essentials of Arizona asset protection and how to safeguard your life savings before a dispute ever arises. You are about to be sued, you didn’t do anything wrong, and you know it’s coming. The process server has been knocking on your front door. They’ve been following you around town. They haven’t actually gotten you the documents and said, “You’ve been served.”
00:22:45
Francisco Sirvent: If you’ve never been sued before, it can be an unsettling moment. Obviously, as a lawyer, I’ve dealt with that a lot. I’ve defended people. I’ve actually had to file lawsuits and have people served. That’s the beginning part of the process. Eventually, at some point, if a judgment is entered against you and you now have a legal court order that says you owe a certain amount of money, what happens next?
00:23:23
Francisco Sirvent: Collecting a judgment is not the same as getting a judgment. There have been cases I’ve been involved with where somebody got a judgment against someone, but the defendant was basically judgment-proof. So they got a really fancy piece of paper, but they got no money from it. How do you do that? Well, I welcome everybody here today.
00:23:50
Francisco Sirvent: I’m Francisco Sirvent. I’m the founder of Keystone Law Firm and Lifestyle Planning, and the combined family office that we have, which is the Retirement Management Office, where we help clients take care of all the things under one roof. Today we’re going to talk about protecting those assets. If you’ve worked your life to finally accumulate something, guess what?
00:24:17
Francisco Sirvent: You now have a target on your back. And that’s where it gets scary. It just does. You know, you work hard, and then you’ve got a target on your back. Are you kidding me? Well, we’re going to talk about what those risks are, what actually are some things I hear a lot of people worried about as a risk that actually aren’t a risk,
00:24:49
Francisco Sirvent: and then, of course, how to systematically insulate your wealth against this stuff. I’m not going to share with you just generic platitudes. I’m going to try to give you some concrete things. Um, this topic is way bigger than what we can cover in 30 or 40 minutes, but I want to give you enough to dispel those myths and give you some concrete things that maybe you should at least learn more about.
00:25:16
Francisco Sirvent: So, I hope you walk away from today with my first goal, which is learning something new. You got a new nugget that you haven’t heard of before. You heard it in a different way. You found something that can apply to you, and this time was valuable for you. You can literally get to the end of this 30, 40 minutes and go, “That was worth it. I learned something new that actually applies to me.” My second goal is this is a great way
00:25:44
Francisco Sirvent: for me to just educate and get out of my head all the things that I’ve learned over these years and share it with the world. We post these webinar recordings on our YouTube channel, so you can go watch prior topics that we’ve done, which are at youtube.com/keystonelawfirm. You can also find them on our website, where they’re all stored and saved.
00:26:10
Francisco Sirvent: And if you’re more of a reader, the whole thing is written out there for you, so you can read the whole thing, too. And if you want to see what future topics we have coming up, you can also view our upcoming webinars and events, and you can register right there. We do all kinds of topics—myself, my partner Michelle.
00:26:31
Francisco Sirvent: We just love sharing everything that we’ve learned because it’s a great way for us to do it. And that’s my second goal: if this is something you realize you need to do something about, this is an easy way for you to get to know me if we haven’t met before, and hear how we do things, how we work, who we are, and how we interact.
00:26:49
Francisco Sirvent: So, this is a great way for you to get to know me a little bit, get to know our firm a little bit, to see if we would be somebody you’d want to interview, and likewise, for us to get to know you as well. So, welcome today to “Garnishments, Judgments, and Lawsuits: Protecting a Million-Dollar-Plus Nest Egg.”
Disclaimers & Who Needs Arizona Asset Protection
00:27:10
Francisco Sirvent: Yes, your first tip of the day: just like I’m going to give you guys all ideas on how to protect your wealth, your nest egg, this is part of me protecting mine. These webinars are general information of an educational nature. This is not specific legal, tax, or financial advice for your situation.
00:27:35
Francisco Sirvent: If you need advice, if you want specific recommendations, sit down with a qualified professional who’s licensed and experienced in the profession and make sure you get advice from them, because it does change from client to client, situation to situation. And you don’t want to take something you learn today and just run with it and implement it unless you’ve done this a lot of times for a lot of other people and a lot of scenarios and you can identify what all those
00:28:06
Francisco Sirvent: roadblocks are. And that’s one of the reasons we started the Retirement Management Office: to bring all those disciplines in-house, be able to see things from different perspectives, and say, “Oh, don’t forget that; we don’t want to miss things.” So anyway, that’s my little tip of how I start out protecting myself. Look, this is a webinar.
00:28:28
Francisco Sirvent: This topic is not for everybody. I’ve found that when I try to teach something that applies to everybody, it kind of feels like it’s not for anybody. So, this really is for those people who’ve saved something significant, and it’s usually about a million dollars or more in their nest egg. Generally speaking, that doesn’t include your real estate equity.
00:28:50
Francisco Sirvent: Because, you know, when you look at implementing comprehensive Arizona asset protection solutions, they’re not basic things that you can just hammer out in an afternoon. And so there might be a bigger investment of time and resources into getting this done, and it has to be worth it on that scale.
00:29:09
Francisco Sirvent: This information is only for people who are not already being sued. There’s not already a threat of a lawsuit against you. You haven’t heard anything. You’re not about to file bankruptcy. Under fraudulent transfer rules like A.R.S. § 44-1004 (Uniform Fraudulent Transfer Act), trying to move assets after a claim arises will be set aside by a court. If you are in that situation, you’ve got to go a completely different route.
00:29:36
Francisco Sirvent: And it’s not really for somebody looking for a shortcut. You know, if you’re looking for those YouTubers that say, “Here’s how you put all these trusts and LLCs and nonprofits together and whiz-bang, boom, it’s done, and you can download all their forms”—that’s just not what we do. So if that’s what you’re looking for, you’re in the wrong spot.
00:29:55
Francisco Sirvent: But if that’s not who you are, I think you’ll find something helpful. The thing that we’ve just come across is that it is really hard to really protect your wealth if you don’t coordinate your advisors. And most people don’t. They don’t know it’s available. They don’t know it’s a thing. But you end up taking that final ownership of liability on managing the different advisors.
00:30:21
Francisco Sirvent: You know, making sure they know what each other knows and that they’re talking, they’re collaborating, and they’re not giving conflicting answers. One person says, “This is what you should do,” and another person says, “No, that’s baloney.” They poke a bunch of holes in it and say, “Do something else.” Now you’re responsible for making sure they collaborate and they are telling you what’s in your best interest despite all of the different facets of your life.
00:30:47
Francisco Sirvent: So it’s something to really think about. You’re sitting in that role as the CEO of your own family operations.
Hidden Exposures and the Layered Arizona Asset Protection Strategy
00:30:47
Francisco Sirvent: So what are these hidden exposures? Inside personal bank accounts, brokerage funds, real estate—these are the things that a creditor is going to go after. You know, we all have them, right?
00:31:12
Francisco Sirvent: We have bank accounts, we have brokerage funds, we have real estate. If you own your home, if you own rental properties—all of these things are going to be the assets at risk. Creditors have to be able to go after something. If you owe somebody money—if it’s a credit card, if it’s a mortgage, if it’s a personal loan, or if a car accident occurs…
00:31:43
Francisco Sirvent: One of the most horrific stories that happened was a client was driving his spouse to a doctor’s appointment. And on the way, he had a heart attack or stroke and ended up causing a very significant car accident. Multiple cars, lots of injuries.
00:32:13
Francisco Sirvent: This stuff doesn’t happen because we mean it to. It happens by accident for the most part. And you’re just living your life. You’re being a good person, you’re doing all the right things. That’s how we want to live our lives. These types of risks rarely come up because you were intentionally taking on a $5 million risk, right?
00:32:42
Francisco Sirvent: They come on by surprise. And being ahead of the surprise, having these plans in place ahead of time, is the only way that these plans work. The first thing to know about an Arizona asset protection plan as a whole is that if anybody tells you it’s a guarantee, nobody can touch it, it’s bulletproof, they haven’t done this long enough.
00:33:27
Francisco Sirvent: They haven’t done it for enough people. The reality is, the best asset protection attorneys in the country know nothing is completely bulletproof. There just isn’t anything that’s absolutely bulletproof, because even if you put together a bulletproof plan, if the client fails to observe formalities as they live their life, it falls apart. Real protection comes down to layers.
00:34:01
Francisco Sirvent: You put layers in between you and your liabilities—as many reasonable layers as you can. And it’s the layers between you and your liabilities that do two things. First, they provide structural insulation. But second, and honestly what’s more important in a lot of settings, is what it does to the opposing attorney.
00:34:39
Francisco Sirvent: It forces the plaintiff’s lawyer, who is the one suing you or trying to come after your money, to evaluate the difficulty of recovery. They have to decide: how hard is it going to be to get to your money, your property, and your investments? If a plaintiff’s lawyer sues someone and sees zero Arizona asset protection in place—none whatsoever—and that all they have is baseline car insurance, what happens?
00:35:03
Francisco Sirvent: They go straight after you. They’re going to try to negotiate a settlement with the insurance company. And if the liability is way more than that, they’re just going to look at you and say, “We’re coming after your personal balance sheet,” because they know how to do it. It’s very predictable.
00:35:19
Francisco Sirvent: That’s a business model they know how to run. But if they look at your situation and see statutory exemptions, properly structured LLCs, and irrevocable trusts, they realize this is a complex web of entity unwinding. What that triggers in their mind is that they have easier cases to work on.
00:35:48
Francisco Sirvent: You want to convince them by your legal structure that they should settle within the limits of the insurance policies you already carry. That keeps your family wealth intact. So you have to step back and recognize that a sound strategy places deliberate barriers between outside claims and your wealth.
00:36:15
Francisco Sirvent: None of it’s magic, but it creates the opportunity for risks to settle within policy limits. That is the core of realistic asset protection.
How Bank Garnishments Actually Work in Arizona
00:36:15
Francisco Sirvent: All right. So, how do garnishments work? If you’ve ever heard of someone subject to a child support order or alimony, you know how earnings garnishments work. The court order goes to the employer, and a portion of their paycheck is withheld before it ever reaches the employee.
00:37:16
Francisco Sirvent: What we’re talking about today is garnishment of non-earnings under A.R.S. § 12-1570 (Writ of Garnishment). That means money sitting in a bank, brokerage funds, certificates of deposit, or other non-real-estate assets on your personal balance sheet.
00:37:40
Francisco Sirvent: It could be corporate stock, savings, or investments. To execute a non-earnings garnishment, a creditor must obtain a formal judgment against you first.
00:38:03
Francisco Sirvent: Once they secure that judgment, they file for a writ of garnishment from the court. That writ is served directly on your financial institution, commanding the bank to immediately freeze your accounts.
00:38:33
Francisco Sirvent: The creditor only needs to identify which financial institution holds your money. And once the writ hits the bank, you typically do not find out until your debit cards are declined and your access is locked.
00:38:53
Francisco Sirvent: The bank doesn’t immediately send the funds to the creditor. Instead, the bank files an official answer with the court detailing how much money you have on deposit across all accounts, subject to narrow statutory exemptions.
00:39:15
Francisco Sirvent: Then the creditor requests a final court order directing the bank to release those funds. In the meantime, your cash is completely paralyzed. You cannot pay household bills, write checks, or cover payroll.
00:39:35
Francisco Sirvent: The bank must freeze the funds because if they allow you to withdraw the cash, the bank itself becomes liable for the judgment amount. Once the court issues the turnover order, the bank sends your money directly to the creditor.
00:40:03
Francisco Sirvent: You receive formal notice after the freeze happens. You can file objections, but you are playing defense from behind. Your liquidity is gone while the dispute plays out.
00:40:20
Francisco Sirvent: This is why keeping $100,000 or $200,000 sitting unprotected in personal savings accounts is risky. Even with today’s attractive cash yields, that exposed capital is vulnerable to an instant freeze the moment a writ of garnishment lands.
Common Myths: Why Revocable Trusts Do Not Provide Arizona Asset Protection
00:40:50
Francisco Sirvent: The most widespread misconception I encounter is the belief that putting assets into a standard trust shields them from creditors. People say, “It’s in my trust, so a lawsuit can’t touch it, right?”
00:41:32
Francisco Sirvent: That belief is completely false. Under the Arizona Trust Code, specifically A.R.S. § 14-10505 (Creditor’s Claim Against Settlor), the property of a revocable trust is subject to the claims of the settlor’s creditors during the settlor’s lifetime.
00:42:00
Francisco Sirvent: If you set up a revocable living trust where you remain the trustee, hold the power to amend or revoke the trust, and can pull assets out whenever you want, the law treats those assets as your personal property for debt collection purposes.
00:42:32
Francisco Sirvent: There is zero statutory separation between your individual liability and your revocable trust holdings. Creditors can attach trust accounts through bank garnishments or force the sale of titled real estate just as easily as if the property remained in your individual name.
00:42:56
Francisco Sirvent: While a revocable living trust is indispensable for avoiding court probate and organizing your estate, it provides no lawsuit shield during your life. Real Arizona asset protection requires independent legal mechanisms.
00:43:25
Francisco Sirvent: When it comes to real estate, Arizona does provide a statutory homestead exemption under A.R.S. § 33-1101, which protects up to $400,000 of equity in your primary residence from judgment liens.
00:43:59
Francisco Sirvent: That $400,000 cap is helpful, but it is not unlimited. Unlike states like Florida or Texas with uncapped homestead exemptions, any equity in your Arizona home above $400,000 remains exposed to judgment creditors.
00:44:46
Francisco Sirvent: Furthermore, rental properties have zero homestead exemption. If you own residential or commercial rentals in your personal name, 100% of that property equity is vulnerable to judgment collection and forced execution sales.
00:45:22
Francisco Sirvent: If a tenant or guest suffers an injury on a rental property—whether from a fall, an unaddressed maintenance issue, or an unfortunate tragedy—lawsuits routinely exceed standard insurance policy limits. Without separate protective entities, that claim directly jeopardizes your personal savings.
00:47:29
Francisco Sirvent: Remember also that the $400,000 homestead shield only applies to one single primary dwelling. You cannot divide or stack that exemption across multiple properties. If your primary residence is paid off and worth $1 million, $600,000 of that home equity is exposed.
Umbrella Insurance Policies and Their Hidden Exclusions
00:47:55
Francisco Sirvent: I strongly recommend umbrella liability policies as an essential baseline tier in any wealth preservation plan. Securing a $1 million to $5 million umbrella policy through your carrier provides significant coverage for a relatively low annual premium.
00:48:29
Francisco Sirvent: The primary value of an umbrella policy is that the insurer has a legal duty to defend you. They hire and pay experienced defense attorneys to handle the litigation, and they work to settle claims within policy limits so your personal capital remains untouched.
00:49:00
Francisco Sirvent: However, umbrella policies are not a universal cure. The major risk is that every policy includes contractual exclusions. If you conduct business activities out of your home, manage rental properties under an improper policy classification, or encounter intentional tort claims, your insurer can deny defense and indemnification.
00:49:59
Francisco Sirvent: An insurer will strictly enforce policy exclusions without hesitation. You must communicate openly with your insurance broker to ensure all properties and activities are covered by appropriate commercial or umbrella riders. But because insurance coverage can fail, structural legal planning remains essential.
Statutory Arizona Asset Protection: Accounts and Exemptions
00:50:35
Francisco Sirvent: Let’s examine the statutory protections that exist directly within Arizona law. While ultra-wealthy individuals sometimes explore offshore trusts, foreign jurisdictions are costly and rarely suitable for estates under $30 million. Domestic Arizona statutes offer robust tools when properly utilized.
00:51:55
Francisco Sirvent: First, qualified retirement plans and traditional or Roth IRAs enjoy statutory exemption from judgment creditors under A.R.S. § 33-1126(B). Creditors cannot garnish your qualified retirement accounts to satisfy personal judgments, supporting the state’s public policy of protecting retirement security.
00:53:15
Francisco Sirvent: Second, Arizona law provides powerful exemptions for life insurance cash values and commercial annuities under A.R.S. § 33-1126(A)(6) and A.R.S. § 20-1131. If an annuity contract or life insurance policy has been in place and funded for more than two years, its cash value is completely exempt from creditor attachment.
00:53:54
Francisco Sirvent: This two-year statutory rule allows individuals to place capital into structured annuities or permanent life insurance policies to establish a statutory shield without complex entity administration, provided the funding occurs well before any legal dispute arises.
00:54:42
Francisco Sirvent: However, these statutory shields have defined limitations. Following the U.S. Supreme Court ruling in Clark v. Rameker, inherited IRAs lose their protected status under federal bankruptcy law. Because the SECURE Act mandates that inherited IRAs be fully distributed within 10 years, every taxable withdrawal becomes exposed to outside creditors.
00:56:27
Francisco Sirvent: Similarly, during your lifetime, required minimum distributions (RMDs) lose their statutory protection once the funds land in your personal checking or savings account. Statutory exemptions protect money inside the account, but unprotected distributions require additional entity planning.
Entity Isolation and Charging Order Protection Under Arizona LLC Law
00:57:27
Francisco Sirvent: When you own multiple properties or commercial assets, entity isolation is the gold standard for risk mitigation. Instead of holding cash, your primary residence, and several rental parcels in your personal name, you separate them into distinct entity wrappers.
00:58:49
Francisco Sirvent: If an injury occurs on a rental property held within an isolated LLC, the lawsuit is contained to that specific LLC’s assets. The claimant cannot reach your other rental properties, personal bank accounts, or family residence, provided you maintain formal entity separation and avoid commingling funds.
01:00:44
Francisco Sirvent: But what happens if you face personal liability from an off-duty car accident or personal claim? In Arizona, a judgment creditor cannot simply seize your LLC ownership or liquidate underlying LLC assets.
01:01:37
Francisco Sirvent: Under A.R.S. § 29-3503 (Charging Orders), a charging order is the exclusive remedy by which a judgment creditor can satisfy a judgment from an LLC member’s interest. A charging order only entitles the creditor to distributions if and when the LLC manager elects to distribute profits.
01:02:40
Francisco Sirvent: If you or a trusted manager oversee the LLC, the company is under no obligation to declare profit distributions to satisfy the creditor. Legitimate operating expenses, repairs, and capital reserves can be funded while profits remain within the company.
01:03:42
Francisco Sirvent: Under federal tax rulings (such as Rev. Rul. 77-137), a creditor holding a charging order may be treated as an assignee for tax purposes, potentially receiving a K-1 tax bill for phantom income without receiving any cash distributions. This potential tax liability creates immense leverage to settle disputes on favorable terms.
Spendthrift Trusts and Multigenerational Legacy Protection
01:04:38
Francisco Sirvent: For multigenerational wealth preservation, spendthrift trusts provide vital creditor protection for your heirs. Under A.R.S. § 14-10502 (Spendthrift Provision), a valid spendthrift restriction prevents a beneficiary’s creditors from attaching their trust interest before distributions occur.
01:05:06
Francisco Sirvent: If an adult child faces a lawsuit, bankruptcy, or marital dissolution, assets held inside a properly drafted spendthrift trust remain shielded from their personal creditors. It functions as an estate planning shield your children never have to negotiate themselves.
01:05:49
Francisco Sirvent: By coordinating your revocable trust, standalone business entities, and testamentary spendthrift trusts, you ensure that wealth passes down securely across generations without court interference or vulnerability to lawsuits.
